L’Art Institute is a Clinical Group exclusively dedicated to Diagnosis, Treatment and Research in Rejuvenation, Medical Laser and Aesthetic and Genetic Medicine , with facilities in Penafiel-Porto, Portugal.

  1. RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA

For the purposes of this Privacy Policy, the personal data controller is LArtinstitute,Lda with its headquarters at Rua Tenente Valadim 438 Penafiel and with the web address: www.lartinstitute.com

  1. LEGAL BASIS FOR PROCESSING OF PERSONAL DATA

Data protection is a particularly high priority for L’ Art Institute which aims to protect the privacy of its users.

L’ Art Institute ensures that all information of a personal nature is treated and protected with the utmost diligence and in compliance with EU Regulation 2016/679 – General Data Protection Regulation (GDPR) and with domestic legislation on the subject.

Through this Privacy Policy, and under the Transparency Principle, you will obtain information on how L’ Art Institute collects, processes and uses Users’ personal data collected in connection with the use of the website: www.lartinstitute.com type of data it collects, the purposes for which it uses them, the data processing methods, as well as Users’ rights in relation to such processing and how to exercise them.

The present Privacy Policy also applies to the personal data that any candidate provides when submitting his/her Curriculum Vitae and managing his/her application. In this way, L’ Art Institute protects the privacy of the candidate and ensures that the information collected is used exclusively for the purposes defined in this policy.

  1. PERSONAL DATA COLLECTED AND LEGAL GROUNDS FOR ITS USE

L’ Art Institute requests personal data in the following menus:

(a) Registration for Assessment Consultation:

To submit the request for Evaluation Consultation on the L’ Art Institute website you must fill in the form, in which some personal data is requested, such as your name, telephone contact, email address. You must read and expressly accept the Legal Terms and Conditions and the Privacy and Cookies Policy in order to complete your registration.

b) Registration for Online Assessment, Diagnosis and Treatment Proposal:

If by any chance you wish to undertake an Online Assessment, you will be asked for the following details: name, age, location, telephone number, email address, best time for contact, how you became aware of L’ Art Institute , type of Treatment, Genetic test or Sisley cosmetic you are looking for. Photographic records will be taken to analyse the progress of treatments and will only be published with informed consent signed by you.

This data will be processed and analysed by our Clinical Team, after which we will reply as soon as possible.

If the information provided is insufficient, the User also gives their consent to the use of their contact details for clarification of what is convenient to the satisfaction of the request, namely, suggesting the scheduling of a face-to-face consultation so that we can make the diagnosis, treatment proposal and clinical recommendation that we consider most appropriate to the needs of the specific case.

By submitting your Online Assessment request, the User gives their express, free and informed consent for your personal data to be collected and processed for the purposes and under the terms and conditions mentioned above, further stating that all information provided contains no omissions and corresponds to the truth

The receipt of the photographic records, which are optional, demonstrates and confirms the User’s consent for the use of the material sent for the purposes intended, by the clinical team, which is under the clinical coordination of Dr. Isabel Rocha.

c) Submit an application:

When submitting an application you will also be asked for some personal data (name, age, country, telephone, city, email, profession and academic qualifications), which are collected in specific fields of the form for this purpose and are not accessible to other users of the L’ Art Institute website.

Processing may also be carried out electronically, in particular if a candidate sends the corresponding application documents by e-mail or through a form on the website.

Since your data will be used to assess your application, you are advised to check the references and other information you have provided. L’ Art Institute will use the data to respond to your application and call you for an interview if your profile fits a position for which a vacancy is open.

Your CV will be stored in L’ Art Institute’s database and will be accessible by our recruitment consultants.

The categories of recipients of the Candidate’s personal data are the Human Resources department and the Team Leader of the function or area for which they are applying.

The recruitment process does not involve automated decision making, including profiling.

The Candidate can update their CV at any time by simply following the same procedure as for sending a new CV. Their old “CV” will be automatically replaced by the new one.

d) Submitting a Suggestion, Complaint or Question:

When filling in the form with your suggestion/complaint/question you will be asked for some personal data such as full name, e-mail address, telephone contact and message. These data are collected in specific fields of the form and processed by L’ Art Institute. The collection of this data is intended to allow L’ Art Institute to correctly identify the entity concerned, the situation reported and the direct contact with the holder of the suggestion/complaint. With the exception of the entity concerned, L’ Art Institute will not pass on your data to third parties for any purpose.

e) Submitting a request for assessment to the Customer Ombudsman:

When submitting a request for assessment to the Client’s Ombudsman, you will be asked for some personal data collected through the form that will be processed by the Client’s Ombudsman for the purpose of analysing and responding to the complaint submitted, the grounds for this being the authorisation of the respective holder when he/she addresses the matter to the Client’s Ombudsman, requesting that it be subject to assessment. The aforementioned processing will always be carried out in compliance with the applicable legislation.

4.1 HOW IS PERSONAL DATA COLLECTED?

Some L’ Art Institute services do not require any form of registration, making it possible for the data subject to visit the company website without needing to identify him or herself.

However, there are other services and functionalities which necessarily require the provision of personal data.

The online evaluation request form available on the L’Art Institute website has mandatory fields (identified with *) and optional fields. Failure to fill in the compulsory fields will result in the online consultation request not being able to be submitted.

L’ Art Institute will only use personal data when they are voluntarily provided by their owners, for the purposes for which they have been provided and always with their consent.

L’ Art Institute pays particular attention to the protection of the rights of minors, so that the collection of personal data of minors under 16 years of age is dependent on the consent of their parents/holder of parental responsibilities. In the event of the possible collection of data from minors, the e-mail address of the parents/holders of parental responsibilities will be requested for written confirmation that they consent to the processing of the personal data of the minors concerned, where applicable.

4.2 PURPOSES FOR WHICH PERSONAL DATA IS COLLECTED

L’ Art Institute holds, uses and discloses User personal data between the various entities of the L’ Art Institute Clinical Group for its legitimate purposes, including:

  • Fulfilling contractual obligations;
  • Informing Users of new services made available;
  • Improving and personalising the service provided to the User (answering questions from the User, processing requests for information and any complaints);
  • Eventually, for marketing and communication purposes, such as, in general, offers, special campaigns and updated information on L’ Art Institute’s activity.

c) Marketing:

L’ Art Institute will only use contact data (name, email, telephone) for direct and indirect marketing actions, which consist of sending manual or automatic newsletters or personalised contacts about news, products, campaigns, promotions or other information, if such option is explicitly authorised by the User. You may revoke this consent at any time by contacting L’ Art Institute directly at institutelart@gmail.com.

You may, at any time, unsubscribe from our mailing list for the sending of the newsletter by clicking on “Unsubscribe” in the email communication or by contacting L’ Art Institute directly at institutelart@gmail.com.

L’ Art Institute will use the data provided to carry out market research, clinical and scientific studies, quality assessment and satisfaction surveys and statistical analyses, if such an option is expressly authorised by the User.

c.1) Profiling:

L’ Art Institute performs profiling based on information collected from visits to the website and the consumption habits of its clients.

This information allows L’ Art Institute to send out personalised information on news, campaigns or promotions tailored to each profile.

L’ Art Institute uses statistical information related to the profiles of its Patients in order to improve its offer, plan its communication, manage campaigns and promotions.

d) Photographs and patient testimonials:

L’ Art Institute may publish testimonials / comments / photos / videos and references of Patients on its website, for the purpose of promotion and dissemination of its treatments and products.

Before publishing these images / testimonials, L’ Art Institute ensures that it has obtained express written consent from the data subject and guarantees that the disclosure of these testimonials / images will not be used for purposes other than those mentioned, unless the data subject is notified and gives consent.

e) Sharing of personal data:

In certain circumstances L’ Art Institute may transmit the User’s personal data to third parties, provided that, for this purpose i) it has unambiguously obtained your consent; ii) when the transmission is carried out in compliance with a legal obligation, a court order or a resolution of the National Commission for Data Protection; or iii) to respond to requests from public or government authorities.

There may be transmission and relationship of personal data between the various entities of the Clinical Group L’ Art Institute and its Collaborators.

L’ Art Institute will also share personal information with third parties who perform functions on behalf of L’ Art Institute and provide services to the company, such as:

  • Professional consultants;
  • Data analysis providers;
  • Function coordinators.
  • Computer and website management and hosting companies

L’ Art Institute may transmit and receive your data to and from subcontractors for the purposes mentioned above, under the terms of the contracts concluded with them. Only the personal data necessary for the provision of the service in question is provided to these companies, which undertake to process the said personal data solely and exclusively for the purposes indicated and under a duty of confidentiality.

L’ Art Institute may also share your data with third parties who manage digital platforms for the purpose of marketing campaigns.

L’ Art Institute will not sell to third parties the personal data that the data subject provides in the enquiry process or in the application submission form.

L’ Art Institute will process your data within the territory of the European Economic Area (EEA) and therefore does not envisage any international data transfer.

  1. DATA SUBJECT’S RIGHTS:

The User has certain rights in relation to the personal information that L’ Art Institute holds about him or her. Details of these rights and how to exercise them are set out below. However, L’ Art Institute will require proof of the identity of the Data Subject before it can act on your request.

For as long as L’ Art Institute holds or processes personal data, Users may, at any time and free of charge, exercise the following rights:

(a) Access: the right, at any time, to request from L’ Art Institute a copy of the personal information that the Company holds about you.

b) Correction or Completion: right to correct data that you consider inaccurate, incomplete or out of date;

c) Right to Erasure: the right to request the erasure of data that L’ Art Institute holds about you, e.g. if the information is no longer necessary for the purposes for which it was collected or processed. This right is without prejudice to compliance with the legal obligations incumbent upon L’ Art Institute with regard to the storage of personal data;

Notwithstanding the fact that L’ Art Institute will make every effort to carry out the measures deemed appropriate to satisfy the elimination request, the total elimination of the record from the systems may take up to a maximum of approximately 30 days.

d) Right to restrict data processing: under certain circumstances, you have the right to object to the processing of your personal information and/or the use of your personal information for direct marketing purposes.

e) Opposition to automated processing, including profiling;

f) Data Portability: right to receive, under certain circumstances, any personal information that the Company maintains about you in a structured, generally used and readable format, and may also request that L’ Art Institute transmit this information to you or to a third party company.

g) Withdrawal of Consent: Insofar as L’ Art Institute is processing the User’s personal information on the basis of their consent, the User has the right to withdraw their consent at any time.

However, this right does not affect the lawfulness of the processing carried out on the basis of the consent previously given, nor the subsequent processing of the data on another lawful basis, such as compliance with a contract or a legal obligation to which L’ Art Institute is subject.

Should the User wish to exercise any of the aforementioned rights or withdraw his/her consent, he/she may do so by contacting:

(i) in person at the L’ Art Institute Clinical Group Units,

(ii) with the L’ Art Institute Group Data Protection Officer through the following contact institutelart@gmail.com.

In the case of data relating to your health, the right of access to health information by the holder (or a third party with your consent or under the terms of the law) can be exercised directly, or through a doctor if the holder of the information so requests, by means of a written request addressed to institutelart@gmail.com.

In the event that L’ Art Institute is subject to limitations and exceptions, it will give reasons why it is not possible to grant the request for the exercise of the User’s rights.

  1. TERM OF CONSERVATION OF PERSONAL DATA

Without prejudice to other time limits provided for by the legislation in force, particularly with regard to tax, accounting, labour and contractual liability matters, personal data will be kept for the minimum period of time necessary and proportionate for the pursuit of the purposes for which the personal data were collected.

For the purposes described in this Privacy Policy, (except for the compliance with legal obligations, whose conservation period will depend on the applicable legal deadlines), the personal data will be kept until the maximum period of 10 years counted from the collection of your consent or from the last registration made and if, within this period, you have not withdrawn your consent.

With regard to recruitment processes, if L’ Art Institute formalises an employment contract with a candidate, the data sent will be stored for the purpose of processing the employment relationship in accordance with legal requirements.

If no employment contract is concluded, the personal data of the Candidate is kept for 6 months after which it is automatically deleted, provided that no other legitimate interest of L’ Art Institute opposes deletion.

Alternatively, the data may be anonymised in such a way that the Candidate is not or can no longer be identified.

  1. SUBCONTRACTING

L’ Art Institute has defined clear rules for contracting the processing of personal data with its subcontractors and requires them to adopt appropriate technical and organisational measures to protect the personal data of its Users.

The L’ Art Institute may communicate personal data of Users to subcontractors, and is always responsible for their processing, provided that there is prior and unequivocal authorisation from the data subject. This is the case with entities providing support services for the company’s computer systems, clinical service providers, consultancies and law firms.

Any entity subcontracted by L’ Art Institute will process the personal data of its Patients on behalf of L’ Art Institute, under the strict obligation to follow its instructions, which should always be given in writing, in compliance with the RGPD, namely with art. 28, paragraph 3 al. a) of the RGPD.

All entities subcontracted by the L’ Art Institute shall be bound to it by a written contract that regulates, inter alia, the object and duration of the processing, its nature and purpose, the type of personal data, the categories of data subjects and the rights and obligations of the parties.

L’ Art Institute shall ensure that the subcontractors provide sufficient guarantees to implement appropriate technical and organisational measures so that the processing will meet the requirements of the applicable law and ensure the security and protection of the rights of the data subjects, in accordance with the subcontracting agreement concluded with the said subcontractors.

  1. SECURITY MEASURES

L’ Art Institute undertakes to take all appropriate measures and to implement technical and organisational measures to ensure a level of security adequate to protect the Personal Data and other information of Users, particularly against their destruction (accidental or illicit), loss, alteration, diffusion, manipulation or unauthorised access and against any form of illicit processing, and continually adapts its security measures in line with ongoing technical developments.

L’ Art Institute ensures technological and organisational security measures for the protection and confidentiality of data collected via its website, having approved and implemented strict rules in this regard. Compliance with these rules constitutes an indispensable obligation for all those who legally access them.

On the L’ Art Institute website, the forms used to collect personal data require encrypted browser sessions and all the personal data that the user provides about him/herself is stored securely in L’ Art Institute’s systems.

However, since it is impossible to guarantee the absolute security of any information sent over the internet (open network), there is a risk of data being accessed by unauthorised third parties. However, even in this circumstance, L’ Art Institute adopts and continually develops security mechanisms to protect the personal data collected.

In the event of a breach of security leading to the accidental or illicit deletion, loss, modification, unauthorised disclosure of, or access to personal data, L’ Art Institute is committed to communicating the incident to the CNPD, whenever possible, within 72 hours of becoming aware of it and without justified delay, as well as to the data subject.

All personal data already indicated, whether information entered by the user, automatic information, email and other interactions with the L’ Art Institute website are stored in secure databases, accessible only to duly authorised and accredited L’ Art Institute employees and subcontractors provided that they are duly authorised, accredited and identified.

Regular backups of all data are made in order to prevent data loss, which are encrypted and kept in a safe place inaccessible to unauthorised persons.

Only duly authorised and accredited L’ Art Institute employees may access, insert and manipulate Users’ personal data and only if strictly necessary. This access is always carried out through platforms with access control and registration. In the case of physical records (on paper), when existing and stored, they are archived in a place of restricted access.

In order for this process to be imbued with a higher level of security and accuracy, the data collected on our website are directly integrated into software belonging exclusively to L’ Art Institute .

L’ Art Institute also records a complete audit which identifies the user, day and time when each piece of personal data was accessed.

L’ Art Institute has prepared and distributed to all its employees personal data protection procedures in order to ensure that they are aware of the obligations imposed on them in this area and has developed training sessions for these employees, who are committed not to reveal to third parties or use for purposes contrary to the law any personal information of L’ Art Institute patients which they have knowledge of in the course of their work.

L’ Art Institute has also appointed a Data Protection Officer (“DPO”) to monitor compliance with applicable policies and regulations on personal data protection. As described in this Privacy Policy.

  1. VIDEO SURVEILLANCE

L’ Art Institute Clinics have a video surveillance system, duly signposted, consisting of a security measure, the installation of the system.

The image recordings obtained by the video-surveillance systems are kept in an encoded record for a period of 30 days, counting from the respective capture, after which they are destroyed (without prejudice to being kept for a longer period in the case of judicial proceedings).

We do not collect sound. The access to the images is not allowed, except by judicial request.

In L’ Art Institute Clinics, there are notices warning of the existence of video surveillance, with the words “For your protection, this location is subject to video surveillance”.

The competent authority in matters of the General Regulation on Data Protection (RGPD) and with the internal legislation on the subject is the National Commission for Data Protection (CNPD), with address at – Av. L’ Art Institute shall give its collaboration to the Supervisory Authority by providing it with all the information that is requested by the latter, in the exercise of its powers.

  1. CHANGES TO L’ART INSTITUTE’S PRIVACY POLICY

This Privacy Policy may be revised and updated at any time by L’ Art Institute and will be disclosed on our website. If it involves a substantial change in the way your data will be treated, L’ Art Institute will notify you of such changes using the contact details it has made available to you.

The Privacy Policy is governed by Portuguese law and will be interpreted in accordance with Portuguese law. If any of the provisions are null and void, the remaining provisions shall remain in full force and effect.

L’Art Institute is the administrator of its presence on social networks.

15.1 ACCEPTANCE OF TERMS OF USE

Access to the pages on social networks (examples: Facebook, Instagram, Youtube, Linkedin, etc.) or their use, in any way, implies acceptance of each and every one of the present Conditions of Use, L’ Art Institute reserving the right to modify these pages at any time. You should carefully read the current Terms of Use each time you access these pages. If you do not agree with any of these terms, you should refrain from using these pages.

15.2. OBJECT

Through the L’ Art Institute social network pages, the user may interact by sharing and uploading photographs, videos, comments and experiences, provided that in strict compliance with the present Legal Conditions and Privacy and Cookies Policy.

15.3. CONDITIONS OF ACCESS

Access to these pages on social networks is free, although it may be necessary to be a member. When requested to provide personal data for access to certain areas of the pages, users must guarantee the veracity, accuracy, authenticity and validity of the information provided, in compliance with the Legal Conditions and the Privacy and Cookies Policy.

15.4 CONDITIONS OF USE

The user undertakes to make appropriate and lawful use of the L’Art Institute social network pages, as well as the content and services, in accordance with the legislation applicable at any given time, with these Legal Conditions, with generally accepted morality and good customs and with public order.

Thus, the user must maintain adequate and appropriate conduct towards other users, without under any circumstances permitting behaviour and attitudes that demonstrate a lack of respect, bad manners or insults. The use of two or more identities by the same person may result in access to the respective pages being blocked, as the use of false profiles which are extraneous or foreign to the profile itself is not allowed, nor is supposed identity theft admitted.

The user must abstain from

-Make unauthorised or fraudulent use of the pages and/or their contents for unlawful purposes or with effects that are prohibited in the Conditions of Use, harmful to the rights and interests of third parties, or that, in any way, may damage, render useless, overload, deteriorate or impede the normal use of the services or documents, files and all kinds of content stored in any computer equipment;

-Access, or attempt to access, resources or restricted areas of the different pages without fulfilling the conditions required for the respective access;

-Damage the physical or logical systems of the pages, their suppliers or third parties;

-Introduce or spread on the network computer viruses or any other physical or logical systems that may cause damage to the physical or logical systems of L’Art Institute, its suppliers or third parties;

-Deleting, hiding or manipulating the notes on intellectual or industrial property rights and other data identifying the rights of L’ Art Institute or third parties incorporated in or associated with the contents, as well as the technical protection devices or any information mechanisms that may be inserted in the contents;

-Obtain or attempt to obtain the contents, using means or procedures other than those which, depending on the case, are placed at your disposal for this purpose, or which have been expressly indicated on the different pages or, in general, the procedures normally used on the Internet, as this does not involve a risk of damage or disablement of the L’ Art Institute social network pages.

Content published by the user on the social network pages:

In particular, and as a purely indicative and non-exhaustive matter, the user undertakes not to transmit, disseminate or make available to third parties, information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any type of material that:

-Is in any way contrary to, belittles or infringes the fundamental rights and public freedoms recognised by the Constitution, International Treaties and other legislation;

-Include advertising of any brand outside the L’ Art Institute;

-induces, incites or promotes discriminatory acts, attitudes or thoughts with regard to sex, race, religion, beliefs, age or condition;

-Incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, racist, xenophobic, pornographic, violent, offensive, harmful, degrading, inciting terrorism or, in general, contrary to the Law, generally accepted morals and good practices or public order;

-induces or may induce an unacceptable state of anxiety or fear;

-is protected by legislation concerning intellectual or industrial property belonging to L’Art Institute or third parties, without the intended use having been authorised;

-includes any type of virus or programme that has not been expressly authorised in advance and in writing by L’ Art Institute;

-The moderators consider it illegal, disrespectful, threatening, unfounded, slanderous, inappropriate, ethically or socially discriminatory or labour reprehensible or that, in any way, may cause damage and material or moral loss to L’ Art Institute, its responsible persons, collaborators or third parties;

Incorporates third-party data without the respective authorisation;

-Is redundant;

-Does not relate to the purpose of the page or post published;

-May be considered spam, published by automatic processes (bots).

15.5. MODERATION OF PAGES:

L’ Art Institute, as administrator of the different L’ Art Institute pages on social networks, consubstantiates the right to moderate the performances and participation of users, as well as the content published.

In the event that a user fails to comply with these Terms of Use, L’ Art Institute may immediately and without prior warning delete the comments or any other published content. Similarly, in accordance with the criteria established by the Institute, it may block a user for non-compliance with the rules.
